This brief work is presented mainly in the service of knowledge: but, in addition to an examination of the legislation of different States, the author has attempted to indicate, at least vaguely, his personal conviction as well, which seemed to him not only his right but perhaps also his duty. He has tried to approach the problem from two angles in an attempt to serve not only the ideas of the victimology but the tasks of the penology as well. Restitution should carry out a mission not only in helping the victim in his present neglected position but, at the same time, in refining the practical concept of punishment. The author's approach differs from current solutions which are almost confined to the sphere of the civil law; however, it also differs from the past solutions in which restitution appeared almost entirely as a criminal retribution. In this work he tries to offer a solution through which restitution may come nearer to the requirements of both victimology and penology. The purpose of this book, he notes, is to offer just such a rough but true picture. This Second Edition retains the first twenty chapters of the original edition, and the new material consists of the last chapter of Part Four, the three chapters of Part Five, an Appendix containing relevant United States state and federal bills and statutes, and an Index.
